Nairobi, January 21, 2025 — Inspector General of Police Douglas Kanja has confirmed that he will appear before the High Court following summons issued by Justice Bahati Mwamuye. The announcement comes after the judge warned that failure to comply with the court’s orders could result in penal sanctions, including imprisonment.
Speaking on Tuesday, Kanja assured journalists of his commitment to honoring the summons. “There is no problem. When the time comes for me to appear in court, I will show up personally and explain whatever I need to,” he stated.
The summons, issued earlier this month, pertains to allegations raised by human rights groups concerning a spate of recent abductions. The High Court had directed Kanja to provide explanations regarding the police’s failure to prevent or respond to the abductions.
Warning from Justice Mwamuye
Justice Mwamuye, presiding over the case, had previously expressed dissatisfaction with Kanja’s absence during the second hearing on January 8. The judge outlined potential consequences for non-compliance, stating, “Ordinarily, when my orders are not followed, I take one of three actions: I find the individual in contempt, proceed to sentencing without mitigation if the violation is clear; or I invite the individual for mitigation and sentencing; or I issue a notice to show cause.”
The judge further warned that if Kanja fails to appear at the next hearing scheduled for Monday, January 27, he would have no choice but to charge and convict him immediately.
DCI Boss Also Under Fire
Director of Criminal Investigations (DCI) Mohamed Amin is also facing legal pressure, having missed the January 8 hearing alongside Kanja. Justice Mwamuye has ruled that Amin, too, must appear before the court or face conviction. Unlike Kanja, Amin has yet to comment on the matter.
The case, filed by the Law Society of Kenya and other civil rights groups, highlights the abduction of seven individuals, six of whom were taken in December. One individual remains unaccounted for, a factor that Justice Mwamuye noted when extending a grace period for compliance.
Police IG Promises Action on Abductions
Addressing the abductions, Kanja assured the public that investigations are ongoing and nearing completion. “I have given clear instructions that these cases be thoroughly investigated and concluded. Those responsible will be arrested and prosecuted in accordance with the law,” he stated. He also pledged to keep the public informed as developments unfold.
Public Concern Mounts
As of the time of publication, no arrests had been made in connection with the abductions, and the DCI has yet to provide an update. The delays have fueled public outcry and increased pressure on the police leadership to act decisively in addressing the issue.
